Going on Yearly Vaccation and Never Come Back

I need kind advice in case I will go on yearly leave and cannot return back.what will happen?? what action company will take If I will not return ??Is there any way company will take legal action against me??

I am working as a System Admin in one of the companies in Qatar.My date of joining is 10.Dec.2014. My contract is open or indefinite but can be renewable after two years .I can avail leave every year but on my own ticket and after 2 year i.e completion of contract on company tickets.

As per the date of joining I am working here from past 5 months.my planning is to go on my yearly vacation that is due in Dec 2015. but I am planning to take my leave in Nov 2015 because in December,Christmas and new year holiday fall and the Flight tickets will become very expensive.

I have got the leave request approved from my Director. I also booked my flight tickets online so that I will get a cheap rate for flight tickets.It will commence from mid of Nov to Mid of Dec.

It is our company policy that whosoever will go on first time vacation will have to provide a guarantor(guarantor is our company person can be a colleague or friend who know me) that I will come back after completion of my vacation.In case I will not come back company will take the penalty from the guarantor of the remaining period left which will be 1 year in my case).

I neither want my company nor my guarantor(my friend) to suffer that's why i will give 1 year penalty to my colleague(friend) who will be my guarantor when I will go on leave.If i will not return back he will submit that amount to the company for the 1 year left.I know it is not a right way It is a breach of contract but I have this option open in front of me.my department director is aggressive in nature and will not approve my resignation.

I need advice in case I will go on yearly leave and cannot return back.what will happen?? what action company will take If I will not return ??Is there any way company will take legal action against me??

Other queries which I wish you guys can answer.

1) If I will get a job offer in Qatar can i come back and join it ??

2) Can I apply and get a job and visa in any other gulf countries after taking this step??

3) Also tell me the calculation of 1 year amount I need to give to it to my guarantor.

Thank you for your valuable comments.Qatar is a nice country.I respect people and culture here.I don't have any plans to come here or any other gulf countries in near future.I am not afraid of resigning but I have seen many cases goes not as per planned that's why I am not doing in that way.Another point is I have purchased my own ticket well advance for Nov 15.It is also not written anywhere in the offer letter(I did not sign any contract yet) that company needs guarantor for the first timers vacation.It is just an HR policy to safe their selves from the people going on paid vacation.As I mentioned I will give money to my friend who will be my guarantor and he will submit that money on the ground that I will not come back due to some personal or family issue.company will anyway get their penalty.only doubt or question coming in my mind is will company can touch me legally after doing all these good (to provide guarantor and give their full penalty on time).

the best loyal way is to approach ministry of interior and terminate ur contract against company in terms of harassment. They wil take necessary action and you can proceed later.

Friend,

Refrain yourself from doing any such act since looking at your post I can definitely say that your manager will make the consequences too bad for you & your guarantor as well.

If you abscond from your current employer you will get a ban to work with other employers in Qatar for a minimum of 2 years.

I would suggest instead BE A MAN & talk directly to your employer about your intentions to resign. Be smart & provide reasons like family issues due to which you cannot manage to stay away from home. Don’t say you are dissatisfied with the job.

Look at your employment contract about resignation clauses & remember there are laws in Qatar which will help you to tackle your manager.

The policy of your company seeking guarantor for your leave is absurd and doesn't have any legal binding as far as I know....

1) You cannot come back on another job visa if you were under there sponsorship.

2) Usually after 6 months the visa here is cancelled.You can go to any other gulf country.

3) As I said before Kindly check if such clause of assigning a guarantor for you, exist in your contract. I am sure there won't be such thing.

Lastly! It is better to resign and go within one month; what is stopping you to resign.
