Bank Loan Case Due to Company Delayed Salaries
I am a Filipino citizen and I wrote this forum to ask your kind advice specially those people or kabayan who has a good heart & same experience to me. I' still working now in my company here in Doha for 2 years & 4 months, last June 2017 our company started giving our salaries delayed and many of us are terminated but I'm not included. I have this bank loan remaining worth 48 thousand QR and I asked my manager to include me in termination and grant NOC because our company is in crisis and my payment in loan would be affected. Until now our company situation is bad and as of today we haven't get our 2 months salaries but the bank called me that I need to pay it and I told them the reason that our company didn't give the salary yet. The bank told me that I need to bring a person to act as guarantor but no one of my friends will stand as guarantor because this guarantor will be the one shoulder my overdues payment. I called again the bank that it's not possible for me to bring a guarantor and the bank replied me that they file a legal case. I went again to my manager and open this problem but my idiot manager just laughing on me and he don't want me to give NOC. Nobody in our company can't tell when would be our salaries and even our PRO and Admin can't help me. My last hope is to bring this matter to the Ministry of Labor but before that can you please give me additional advise. You're sincere advise will be highly appreciated.
Edoy22: Suggest you talk to the National Human Rights Committee and seek their assistance telling them that without a salary and a job you may eventually land up in jail when the bank sues you. NHRC may help you out by talking to the employer into giving you a NOC using their powers and influence. But prior to taking this step, possibly you could discuss the issue with someone in your Embassy who may also be able to guide you, hopefully better than me.
acchabaccha: Thank you very much for your sincerity and prayers even you are kabayan. My 2 months salaries is not enough to settle my bank loan remaining 48 thousand QR and it takes me 1 year to pay it all. Actually, I didn't expect this to happen but I need to face the situation. In my own idea, the last hope is to find a new employer and take my gratuity and unpaid salaries to my employer now and pay to the bank but I need to be sure that the company will grant me NOC because if not then it will be useless. My company is dying and my boss is just pretending that it's okay.
Edoy22: I feel the pain you are going through. You are in a difficult situation now. I doubt very much if someone would be standing as a guarantor for you. As such, the bank will have no option left but to take legal action against you and should that happen, it will just add to your pain and problems. The question is: Is your unpaid salaries lying with the company enough to pay off the loan? If the answer is yes, then I suggest you first take the matter to the National Human Rights Committee for assistance who may call your company. They may also ask the company to give you a NOC so that you can find another job and settle the loan. If the matter still remains unresolved, then take the matter to the Labour Court which will get you your dues from the employer. On the other hand, if you still feel that eventually the company's business situation will improve, then just manage to bear on and continue somehow with a smile of the face and a frown in the heart. This is because approaching the NHRC or the Labour Court may get a retaliation from your company and they may send you on an exit.
