Good day! I would like to be enlightened with this issue. Anybody here who can help me.
My wife work here in Qatar for 2 years as a Nurse in private Polyclinic. Our plan is not to renew her contract anymore this end of the month August, because I am entitled to sponsor her under my name(husband sponsor). I work @ MOI. her company refused to give her NOC.

The Plan:
1. She will just finish this month, and go home (notice not to renew her contract given a month ago)
2. And I will process her documents under my sponsor
3. Then bring her back here @ Doha under my sponsorship
4. Get work ID from labor department for her to be able to work.

Question:
1. Is my wife can still work without NOC from her previous employer, after she went home and back under husband sponsor?

2. Is our steps are on the right procedure?

Please help us. Your ideas will be highly appreciated. Thank you in advance.

KABAYAN, an employee under sponsorship is not allowed to leave the country, without No Objection Certificate from the employer. Without the release letter from the employer, the employee will be banned for two years from entering Qatar. Sponsors are not allowed to retain passports of their employees except for any visa formalities. Sponsored employees can bring in their spouses and children to Qatar under personal sponsorship.

Of course there is a record of your wife in the immigration for working in Doha but it will not affect her application for a work permit if she wants to work in the future. Beware of these PROs who wants extra money from you. Based on my experience, you do not need them. It is important you take care of family RP for her first. Once she is under your sponsorship, the new company she wants to join in will be the one to process all the formalities and documents for her work permit.

Husband sponsorship is not affected by 2 years ban ryt? But One of the liason officer in my work said there's a 2 years record previously in her first job here. He said he can arrange for it. He will talk to one of the mudir officer in immig. To cancel that 2years, so that she can work allatol. But it takes a lot of penny.. What do you think ma'am?

Once she is under your sponsorship, she can apply for a job. Her NOC will come from you allowing her to work. Then her new company will apply work permit for her. The work permit issued is in the form of an ID card.

Thanks to all your comments.. It helps me alot. So She needs to exit to Philippines, visa must be cancelled, arrange papers for family visit visa initially, then if she's already here, Next is apply her for husband visa..

Chamelion, you mean Eventhough there's no NOC, she can still work or it depends on the company you're applying for? How can we get a valid working permit? Thanks.

Kabayan, I was in the same situation as your wife previously. What I did,

1. My company refused to give me NOC so I cancelled my visa and exited Doha.

2. My husband processed family visit visa for me initially so I could come back to Doha right away.

3. When I got back to Doha, my husband processed family RP for me.

4. I am now working again with a valid working permit....so yes she can work again once she is under your sponsorship. No need for NOC from her previous employer only from you as you will be her sponsor. Good luck:)

NOC still a requirements to transfer under your sponsorship. Well definitely she can come back anytime BUT not as husband visa instead under VFamily visit visa which will be renewable up to six months.

Still you to wait until to ban period is completed in order to transfer to husband visa.

However, if you know someone inside moi who is powerful enough (wasta) to cancel the Ban then its good for you.

One of my friend resigned w/o NOC /Ban and he able to come back and get another sponsor.

Because she cannot get NOC, 2 year ban for her to work in Qatar will still apply. However, she can come back under your sponsorship, but MoI may will not let her work. Check with your PRO.

Hi,

with respect to Ram, i will have to disagree with the opinion you have given. pede mo makuha asawa mo ulit d2, kahit naka red stamp sa passport indicating na cancelled cya at banned for 2 yrs (as per regulations) pero meron loophole yan, sabi lng naman bawal k bumalik under working visa ulit d ba? eh ba2lik ang asawa mo under your visa, so nde cya magtra2baho - pag nakuha nya na iqama nya under your visa, saka n cya pde mag apply ulit sa work n gus2 nya pasukan, pano k alam? ganyan ginawa k sa asawa k before, hanggang ngaun ksama k p din d2. basta pag nag apply ka ta2nungin ka tungkol dun sa cancel cya, sa2bihin mo lng nde naman cya mag work d2, bagkus gus2 mo lng magkasama kayo as a family. (konting drama would be better :D )

Kabayan, Bhadz. Isa pa an diyan ka na pala sa MOI so ask them to be CLEAR your problem now. Good Luck.
