Visa cancellation without passport

Can my sponsor cancel my visa even without my passport? Thank you guys...

hi,

im working in Qatar ,i got a visa for my wife as a house maid and she did not came but i told the sponsor to cancel the visa but in moi the visa is still there it shown as valid to use.after one week i got a good gob offer to my wife and the new sponsor trying to apply for the visa .but now its two weeks still we did not get the visa i think it happens because of the old visa problem.i need to know ,(1) is i can cancel the visa because she did not use the visa. (2)if its cancel is she can come to Qatar. (3)what is the best way to solve this problem. please help me....

Azilana...I have a friend, he has an ongoing case filed against his employer and they said that his passport already submitted to CID but not sure of this info. He went to the Human Rights and advised him to get his passport in order to issue 'Temporary Work Permit' until he gets the final result of the court....just to earn for a living while waiting. My friend is afraid to go to CID coz there is a hearsay he might send straight to deportation area. What can he do?

Your e-mail resignation is not valid unless you met an accident or got VERY SICK with medical impediment.

Doing what you said (not coming back) is still considered absconding because you still ran away from your work obligations here in Qatar. That is also considered BREACH of CONTRACT.

However It would still be the prerogative of your employer.

In example: Our secretary did that last year. Her mother suffered massive stroke and we allowed her to go on EMERGENCY LEAVE. She decided not to come back. She returned all company assets (laptop, blackberry, petty cash fund etc). I just had her visa cancelled so maybe she will come back next year without needing an NOC from our company.

Unless our mandoop filed her name as blacklisted in the system. I better ask our mandoop tomorrow, me think.

another question.. what if the employee is out of the country and on vacation and decided not to come back? Can it still be considered as Absconding even if he tendered his resignation thru email?

she explain the plausible fact of visa cancellation and support it with various cases she encountered which proves the possibility to cancel the visa without the passport. on the other hand someone just can't get the clear picture...which is not worth wasting energy as I would say...just typical incompetent attitude...she's quite right not to get involve any further about this crap...

She was taken to court for a hearing and the embassy staff were always with her! they introduced themselves to us! we did not file the case the fact that she run off with a man and was found in his accomodation, that is the reason she was sent to jail! we gave her flight ticket and her embassy kept it and the last thing we heard she was deported after 6 months of imprisonment! there's no money involve, end the story!

Jjh, the only way any Embassy can help is provide an air ticket to the deportee if the original sponsor filed a case against his/her employee saying the person has absconded from you as a employer.. As per Qatar law with NO Wasta the employer can withdraw the report or absconding claim by paying a penalty of Qrs.6000/- and the employee returns back to her original employer and life goes on OR the employee pays the Qrs.6000/- and gets deported but is able to return to Qatar on a new visa...

FYI! we did had a Philippine maid who worked with us for only 3 months, run off with Pakistan man although she's married with 11 children in the Philippines! She jumped off the ship so we had to report her to CID she was nicked after couple of weeks and was sent to jail for 6 months but was rescued by your embassy. since then I learned my lesson not to hire any of your fellow country people! Just not worth of trouble!

But the topic here is, if the visa can be cancelled without the presence of the person's passport so I said Yes! and that is what we did after the maid run away with her Pakistan lover, her visa was cancelled!

You probably got me mixed up with the owner of this account! if you are talking about jj and your old crap with her its your problem not mine! She's still back in UK, still chilling! She told me this site is useful. I don't owe you an explanation about her.

FYI...I've been in Qatar for 7 years...of which 2 years

are spent dealing with the Immigration, Labour Office, CIED and other government agencies.

For the last 3 years, I've been dealing with the same agencies, different embassies here in Qatar (not only the Phil Embassy)because my JOB revolves in HR/RECRUITMENT/ADMINISTRATION.

I'm not into lifting my own chair...but with my work experience and hands on exposure, I am more qualified answer questions regarding these HR matters, don't you think?

But of course, there is QatariSun, Seasons, Khanan, DaRude, and other QL folks who are also in the similar field of work could give great inputs on these matters as well.

Your husband is British working/worked in Bahrain...NOT IN QATAR. Here in Qatar, different law applies. And you already contradicted your first post. You said the Embassy "provided" a lawyer. Now your second post "was guided" by the Embassy...which I directly pointed out in my post.

Have you ever been to the Philippine Embassy and requested legal assistance in any way? I don't think so. Coz apart from documentation attestation/authentication, renewal of travel documents (i.e. PASSPORT), the Embassy could only mediate between their citizens and the employer as they (Embassy officials) are still bound by the QATAR (Labour)LAW...IN QATAR. That is why there is that section in the Phil Embassy called 'ASSISTANCE TO NATIONALS'.

Your husband is a British National, an EXPAT and he is dealt with a different hand compared with the Asians...A FACT.

the qatar immigration will not cancel you under the circumstances you just enumerated? Why then was my colleagues husband from another firm cancelled even if he still had a court case and owns a car registered under him?

Even without your passport! All they have to do is report you to the immigration that you have gone AWOL! then the immigration itself will report the case to the authority providing your employer a cancellation of visa documentation with stamp from the immigration and voila! your visa is cancelled! after that unfortunately, you become subject to CID and when they find you, you are going to be under process for deportation! But, if you wish to defend yourself the safer way to do is run to your Embassy and they will help you providing a lawyer to review your contract and see if either you or your employer had breach the contract! If you're lucky enough to win the case, your employer is responsible to pay you the rest of your contract including how many months left based on your monthly salary, gratuity, flight ticket and an exit visa if not? they are still responsible to get you an exit visa and a flight ticket to go back home!

My husband had similar case in Bahrain and he was guided by the British Embassy and it was processed by Labour court and he won the case and they had to pay him until the end of the contract which is another 13 months out of 2 years contract plus what's all included in the contract.

Another case, my husband's colleague killed another colleague and British Embassy helped him in the prison. So don't tell me our Embassy will not help us! NOT ONLY MAIDS ARE ENTITLED TO ASSISTANCE AS WE ARE NOT MAIDS! but we are entitled to assistance from the Embassy in any country where we happen to be!

Yes, your visa can be cancelled electronically via E-government without your passport. Your visa cannot be cancelled if you have dependents on your sponsor, have a legal case or even if you own a car..

-> Running to the Embassy is what absconding housemaids do.

-> The (Philippine)Embassy will not provide you a lawyer, but give legal advise.

-> Even the British Embassy don't have this services to its citizens.

(2) REVISE the contract? Maybe you mean REVIEW?

-->The Contract of Employment is standardized as per Qatar Labour Law. For any employment disputes between the Employer and the Employee, The Labour Office and Human Rights Office are two of the government agencies/departments that could assist on this matter.

the RP ID (together with your passport) should be submitted to the Immigration to cancel it.

HOWEVER, THEY(your sponsor) can report you to the CID as absconding/absconded to release them of any responsibility of you. When they get that clearance from the authorities, they will no longer issue you an NOC letter, and may even report your whereabouts to the police and have you deported. That would be the worst scenario.

This happened to someone I know 2 years ago. I'm not sure if the procedure changed.
