Gratuity and Leave Salary
As per Qatar Labour Law ,what is the calcultion of gratuity and Leave salary?
I have few doubts regrding both noted,
Gratuity:If an employee completed 05 years, he is eligilble to get 30 days /21 days Leave salary?
For eg.Basic 3000,completed 8 years,
Calculation-3000*21/30*8
or
3000*8
Or
5year -3000*21/30*5+3year (3000*3)
Please answer which is correct?
Leave Salary means Full Salary Correct? ie (Basic and Allowance )

The worker shall be entitled to gratuity for the fractions of the year in proportion to the duration of employment.
Gratuity = (basic salary / 30 days) multiplied by 21 days per year .
Leave salary: below 5 years is 21 days & above 5 years is 28 days.
What would be the calculation in case of 26 years service?
Came to know that the maximum is 10.is it true?

eg: Basic QR 4000,Allowance-QR 2000
What is his leave salary?-Is it QR 6000/- or Only Basic(QR 4000/-) or (4000*21/30=QR 2800/)
Which is correct?
@qaac, while some people say that after 5 years of service, gratuity is based on 30 days of salary which is not right. Even after 5 years, it will still be 21 days.
The labor law only says following for Gratuity payment.
Article (54)
In addition to any sums to which the worker is entitled to upon the expiry of his service, the employer shall pay the end of service gratuity to the worker who has completed employment of one year or more. This gratuity shall be agreed upon by the two parties, provided that it is not less than a three-week wage for every year of employment. The worker shall be entitled to gratuity for the fractions of the year in proportion to the duration of employment.
The worker’s service shall be considered continuous if it is terminated in cases other than those stipulated in article 61 of this Law and is returned to service within two months of its termination.
The last basic wage shall be the base for the calculation of the gratuity.
The employer is entitled to deduct from the service gratuity the amount due to him by the worker.

Generally all good companies divide Basic salary by 26 to get the daily salary. The law is to pay 21 days salary for every year worked and this also applies on pro rated basis after one year of completion.
This gratuity is only on basic salary and allowances are not considered.
If you have a contract which pays you overtime as well then the best way to calculate your daily salary is as below. This will remove the confusion on weather your employer is calculating the daily salary based on 26 days or 30 days.
OT Rate / 1.5 = Regular time Rate.
Regular Time Rate x 8 = Daily Rate.
Daily Rate x 21 days = One year Gratuity.
One Year Gratuity x Years Worked = Total Gratuity.
Dear All, Please confirm after 5 years gratuity base ,there is no any change! Is it fixed(21 days ) ?

Can you please explain why basic salary will be divided by 30?
because basic salary not includes Friday overtimes I have seen almost everywhere they pay overtimes for Fridays so why basic salary is not divided by 26? Its in favor of employee if it is divided in 26.
