Advice for an accident case
My car had hit a pedestiran one year back. he was crossing from non desiganted area while there were designated areas for crossing nearby. he was in the hospital for almost one week and discharged. Latter, the case was referred to court from Traffic Dept. Now the court has called for sitting. Does any one have expeirence of going through the procedures? Is the driver always held responsbile even if pedestrian is making the mistake? what are proceeding at the court.

no experience myself; but i suggest you take your most co-operative and humble self to the hearing..admit that you obviously hit him, but that there was just no time for you to react and there was nothing you could have done differently..speak politely and softly ( everyone should do this all the time anyway)..DO NOT try to tell them the law by bringing up the 'non-designated area' aspect..it will definitely put them on the defensive and make them hostile..the aim is to win their empathy and kindness, make them see you as an unwitting victim too..best of luck..
Whether the person was crossing from the designated area or not, is not important. The first right to the road is for the pedestrian, you should have been more careful.
All the best for the hearing in court anyways. Show guilt in the court, at the same time point out clearly that it was the pedestrian's fault. You will do fine.
If the person who was injured is o.k. now, then you may get some fine in the court. Nothing to worry.
People should also report to Traffic Dept and Court, if they hit a birds and cats on the road, its the driver's fault!

Unless it was night and passenger jumped from nowhere, but again you have "Emergency Brakes" to avoid more damages,and if its day time you'll be held responsible becoz you should have seen him if you were concentrating on road otherwise it might be concluded may be you hit him deliberately..Now you need a lawyer to defend you ...all the best..
