DEMOTION
By mylegalinquiries •
My employer informed me that they are demoting me and will make a pay cut in may salary. I am still doing the same work and with additional workload after demotion. Essentially, they just want to make a pay cut to avoid paying me my benefits. I will be receiving the same amount but now this will include my housing allowance. (i.e basic salary before= 16k ;basic salary after demotion 12k + 4k housing benefits with my approved family status) Is this legal? I want to hear your opinion before I take my case to the Labor Dept.
You can simply disagree the demotion, but if you're contract doesn't mention a specific period of employment (that is written "open peiod") then they can let you go by giving you a one month notice anytime they want...it happened to me and I agreed for the demotion (when i was employed). Only then i stopped effort working, and sat to earn only my salary (that they agreed to reduce it to) and didn't do any efforts whatsoever. I came whenever I want and left whenever I want, took vacations whenever I want, missed offices whenever I want. Until the day a letter came to me (after several months of demotion) TERMINATION.It made me soooo happyyyyyy, and I smiled..... They gave me 2 advance month salaries, 1 month end of benefits, 1 month paid leave....All in cash..and they gave me an NOC....
You see, I did that (the no efforts work) because I felt no appreciation whatsoever. Even though I improved their business, developed it, trained their employees, made them a great reputation ... BUT ...human nature!!!!.... they were greedy people who wants only to look for their own benefit, and they don't care about your performance, nor your professionalism, nor your efforts. They just care about how they can abuse the BEST out of you for their own benefit, ignoring your rights to live as you really want...to an extent the psycho MD asked me rudely to change my 8,000 K rent apartment to a 5000 K one... hahahaha.... I screwed them ... and thanks God and Jesus... I have my own business now :)
this is a TRUE STORY!!!!
you should be smart here...but be careful
cabbage and aftab_thana- thank you for taking time in replying. I did not do anything wrong. They just don't want to honor the contract and justifying it by assigning a lower job position yet i am still doing my old work :(
if the salary they offer you is low than in your agrement then you can go to labour court
I don't know what you did - I don't even need to know that - but yes this can happen and NO there is nothing you can do about it.
This is just the way it is over here.
It can happen to us all at any given time. Nobody is better than anybody else really - we can all be demoted or sacked for anything and we have no legal rights.
We are all the same really - we are needed and asked for but as soon as we tell them what is needed and they decide that is not what they wanted; we are got rid off.
Best to keep your head down - kiss your a**, put the money in the bank and go home when you want to.
