GRATUITY PAYMENT
By islaw_2011 •
I worked for a Malaysian Company, a general contractor inside the NDIA New Doha International Airport. My co-employee has resigned but the company did not gave him any EOB-end of service benefits(gratuity payment). My company told him that his contract was signed and made in Malaysia and the gratuity was not stipulated in his contract. Is it legally right? We worked here in Qatar not in malaysia, for me, we are entitle to received also the gratuity payments...
Any answer to this question will be highly appreciated..
Thank you..
He is entitle for EOB, must completed one year with same employer under article(54)qatari labor law subject to under article (61), if they are not ready to pay, could approach to labour department.
best of luck
Thanks for the prompt reply..Im not sure the contract has been attested by the Ministry of Labor. My contract is exactly the same as his..we were hired from the Philippines through agency, We've signed the employment offer letter from the company, and the agency had take care the the rest of the paperworks. When we arrived here in Qatar, we had signed another employment contract with arabic translation (which I have photocopied it with my signature but without the signature of my employer). According to our PRO the contract that we had just signed was for our Qatar I.D application purpose only. I feel that my company will do the same with me, when they decided to end my services with them. I have already served the company and the Qatar Government I would say for 3 years now. Anybody has a view on this pls. reply..it would benefit many of my collegues with same situation. Thanks!
Please check if his contract has been attested by Ministry of Labor. If yes, then he is entitled. He can go to the labor department and file his complaint.
