ESG Contract Basis of Calculation

Employers often get the employee to sign an Arabic version of their contract which shows earnings far less than actual, for the purpose of filing with the Ministry. I do not recall doing this, but after working for a company for 18 months, I have been presented with one that has my signature on the last page but not on the other pages that show the earnings. As this is my second employer since I came to Qatar (and was aware of this deception at the time), I suspect that they have replaced the other two pages in order to convince me that I signed on this lesser amount.

Is the End of Service Gratuity calculated soley on that filed Arabic contract or would the Ministry force the employer to base the ESG on the actual earnings if I were able to prove the actual amounts paid, through presentation of payslips and my English contract?

I went to the Ministry today and it went brilliantly:

Accepting the premise (right or wrong) that my filed Arabic contract was legitimate, I demonstrated through pay slips and timesheets that I had gotten a "raise" from the original Arabic amount to my current actual wage. As ESG is calculated on my "last Basic Wage", which accounts for pay raises, they acknowledged that I simply make more money now than I did when they filed, and the ESG is to based on this new amount. Justice prevails!

BTW - Nobody else in my office remembers seeing the other two pages of the contract when they signed their top page either. Interesting...

Yes, I do that too. In fact, when they challenged me on that, I showed them a copy of my English contract, on which I had signed not only every page, but initialed every paragraph! Wouldn't it be wonderful if I went to the Ministry and found another version, on which I had changed the amount, on file? If they did this (and I am not saying they did), I suppose that they would have made the switch before they filed as opposed to just now that I am claiming ESG. We shall see...

You can do it, what they did is simple forgery... (That's why I sign EVERY PAGE of anything I sign, and I keep a copy).

If you can prove that they did that, you can complain and get your dues.

Jack78 - Thanks for the reply, but my question is much deeper than that. I am aware of the formula for how ESG is calculated but I need to know specifically what the Ministry calls "Basic Wage"...will they only look at the contract that was filed with the Ministry or will they consider the amount that I can PROVE that I was ACTUALLY paid? Also, if it is indeed based on the Arabic version only and I do not trust that my employer is showing me a legitimate copy of my Arrabic contract, can I ask the Ministry to retrieve and show me their copy?

end of services benefits is 3 weeks worth of salary, per year,

it is only payable if you work for more than one year

easy way to caluclate

take monthly salary x 12 (months)

divide answer by 52 (weeks per year)

multiply answer by 3

the answer if your annual ESB, if u worked 18 months,

you multiply your weekly salary by 4.5 weeks.

hope this helps

by the way it son your lastest basic salary only.
