Lease Agreement
I currently have problem with my Landlord, I signed the tenancy agreement for 1 year,and its expiring on September 2009 due to the service termination letter given to me by my company I am forced to terminate the agreement, I inform my landlord about my situation and that I have to vacate the flat end of May 2009 which I did.
I settled KAHRAMAA and everything and turn over the hosue key to my landlord, when I asked for my remaining cheques, he told me that I have to pay one month extra rent, is it the landlord's right? My company is giving me 3 months time to search for a new job, in this case I will be still here in Doha to try my luck but financially unstable due to this the one month extra my landlord is asking is not possible for me to pay.
I reviewed the agreement and there is nothing mentioned that once i decided to vacate I have to pay for extra one month. I am wondering why they have to do this since when I receive the termination letter, I immediately inform them.
Any advise what to do with my landlord since he dont want to listen to me? What is my legal right as a tenant and theres?
if it is not in the contract then contact a lawyer, they are VERY expensive here but you might just save the difference and it could work out cheaper than paying the money grabbin landlord!!!! good luck! u will need it! :-)
Hi Jonboy, there is no such clause, this is the reason why I am insisting with my landlord to review the agreement before demanding payment from me, what I am concerned is that he is holding my 2 post dated cheque, one is due this 6th June and one security undated cheque.
hi.. the penalty is sometimes not mentioned in the lease contract. check the clause on early termination. if it says that you have to pay until the expiration of contract, then you are liable for penalty. if no clause mentioned on the the early termination, then it is understood that you are deemed to finish the period of contract. and still liable for penalty in case of pretermination.
your contract should state the period of time required upon termination. This is usually called the notice period. it can range from 1 - 3 months depending on the contract. Check first. Whether you move out early or not you will still be oblided legally to pay for the notice period, unless the landlord is accepting of your circumstances. if there is nothing within your contract or indeed you have spent the notice period, tell the landlord to fuck off!
If you got some job here in Qatar then again your landlord ask to pay for complete period so its better to stay there if your landlord return you cheques then its the best possible solution otherwise it can cause some problem to you in getting EXIT as well.
My suggestion to you is to fnd some job elsewhere in GCC as if you still have Qatar visa you can get on arrival visa of some other GCC country but if you stuck here then it can be really very difficult for you to leave even.
Hi Renz eventhough its not mentioned in the contract? Is it legal that landlord has to charge one month?
hi just wanna give you my comment based on the practice we have here. im with real estate and we are also the landlord.
Normally, lease contracts say that in case of pre-termination, the tenant has to pay the rest of the period of the contract. However, if your landlord is kind enough not to charge you the full contract, there is penalty based on your monthly rent equivalent to one or two months.
It also depends on the reason for early termination.
