URGENT help - with ref to Q-Labour Law

This is important for me:

My RESIDENT PERMIT is stamped by my present company / sponsor. However I have not been confirmed yet and it has been 8 1/2 months in this job.

 

My probation was extended after 3 months (like others who joined with / before and after me - in entire 2007)

 

And this is what Qatar Labour Law says in Article 39

 

Article (39)

The service contract may contain a provision subjecting the worker to a probation period to be agreed on between the two parties provided that the probation period shall not exceed six months.

The worker shall not be subjected to more. than one probation period with the same employer.

The employer may terminate the contract within the probation period if it has been proved to him that the worker is not capable of carrying out the work provided that the employer shall notify the worker thereof before at least three days from the date of termination.

 

My question is simple:

Am i allowed to switch over in this case and also get a NOC from my employer without any problem.

 

I really dont want to work for such an employer.

You know what I am wondering..

For what you need the probation time, when you are bind on the employer anyway, because of the sponsorship? You as an employee have no advantages out of having a probation time, but the employer has, as he can fire you more easily.

I heard about 2 possibilities to solve this problem:

Firstly, you make sure (before signing the contract) you get this NOC letter in case you want to quit after your probation time.

Or secondly: The company lets you work during the probation time without preparing the sponsorship. You work on business visa for the first 6 months. After that period - when you feel comfortable in the company - you get the sponsorship.

Correct me, if I am wrong!

Anyway, the second proposal is suitable onlyif it is a legal way of doing it, which I do not know..Does anybody have experience with that?

well now i am a little confused

# let me clarify - i have signed my part of the contract

# the apprisal papers (which in our company means confirmation) are still on my desk

# I do not have the contract copy with me.. which i think is not signed yet by the other party

Not if you already signed the contract and he has to give a reason for extending the probation time which you also have to sign in agreement .

if u been in work for more than 6 months thats means u are confirmed automaticaly

no need for a letter of confirmation, if he didnt want to confirm u he should have informed u before

May be your boss/sponser is one among the Qler's watching your comments and you wouldn't get a release / NOC. Be loyal, friendly and co operative with your current sponsor. Normally the maximum probation period is 6 months, after that you are a confirmed employee dont worry about that. If your immediete superior is like that why dont you go and ask his time for a meeting and what is he expecting from him, be frank. If the meeting is not fruitful go to the HR and report about this and tell them that you are been harassed man.. For every problem there is solution, just think well before you act and be prepared for anything..

 

Life is a challenge, just face it , think positively and have self confidence man.....

Always suggest your friends/relatives  to come on business visit (extendable for 3 months) to check the employer and the offered job suits you or not.

 

If it goes negative, you will always have a chance to exit country and come back again on other company visa (Without NOC & Release).

Yes......

 

but i suggest complain to respective embassy before leaving the job or country so that these type of employers will be black listed in Labor Dept.

As per Qatar law, the employer has the right to reject your NOC or release which is very bad ;-(

 

You are not allowed to switch, you have option to quit and go back to your country.
