Company will not let me leave.

Hi

I am after some advise on the current situation I have:

I am working in Qatar on behalf of an Australian company, I advised the Australian company two weeks ago that I need to go home my ticket was arranged, but the company in Qatar would not give me my passport back and stamp it with a exit permit I do not even know what permit I have!!, because there is no replacement for me, I advised the Australian company this many times and today they advised me there is no one to replace me and possible will not be, so the Qatar company will not let me leave, I then refused to work until i get a passport and permit and the Qatar company advised me no work no passport!!

This is a matter for both company's to work out and I am in the middle and just need to leave Qatar, money is no issue, a ticket I have I just need the passport with the exit permit.

Can you give me some advise on what i could do to get this passport back and if/when I do, do i need this exit permit, I do not have one of thoses residence passes, i have been hear for two weeks so I assume I have a work permit.

Any help would be much appreciated

Hi guys and girls. I am coming to Qatar soon. My wife is in London and we are planning to go Switzerland for X-Mas. This exit visa thing is making me worried. But what Karin says makes me feel a bit better. Can anyone confirm that if you are in Qatar for less than a month you can just leave and come back? Do you have to apply for a new visa when you come back?thank you

you dont know your visa either? i remember our PR officer told me that if you are under visit/business visa and you stayed here for less than a month, you dont need an exit permit to leave the country.

Maybe they spent for your coming so maybe u hav to pay before leaving how much cost them in your coming to qatar.

1) they cannot keep your passport, they can 'hold' it.

2) check your contract, I'm quite sure that it says that you cannot leave until a replacement is found. (90% of contracts I've dealt with have such a clause)

3) Check the contract for a method of termination. Find it and then act upon it to make the contract void. OR have a strong reason for leaving e.g. family member dieing

...The company HAS NO RIGHTS to keep you here....go to "Follow and Search Department", which is in Industrial area. This department will request your Company to return your passport and to issue an Exit Permit for you. Check your Messages. I sent you a phone number of someone who can help you with that.

what use is it to have your passport when the company is not willing to give you an exit permit?

By rule they are not supposed to keep your passport.

Whatever happens unless they give you an exit permit you cant leave.

If you don't have a resident permit you will not need to get an exit visa. Exit visa's are electronic now.

The company does not have the right to keep your passport but it is common practice in Doha. Sometimes they keep it while they process your visa and sometimes they keep it longer. If you really must get back then you have to get legal advice and contact the Ministry that handles Labour affairs. They are actually not so bad especially if you are a citizen of a "western" country like Australia.

If you are Australian and the company has a head office in Australia, then you should be protected by the rights and privileges of Australian law (although I don't think Australia has any Bill of Rights for its citizens). A simple letter from an Australian lawyer to the corporate head office might be sufficient. I know that this has worked for Canadians employed by CNA-Q when they were denied exit visas.

If you are not Australian, then I would suggest that you approach your own embassy about this matter. They may be able to lean on the Australian charge d'affairs on your behalf.

Failing that, ask if you can go to Bahrain for a weekend and then keep going.

Say I get my passport back or maybe a emergency replacment from the embassy, and the company still will not give me an exit permit what are my options??

Is the exit permit a visual stamp in the passport or is it electronically lodged with imagration???

Is it true that when you commence employment in Qatar it is the law to surrender your passport to the employer??

Thanks Heaps for your reply, the issue is if i go the Qatar company has no one to continue with the contract, so they will lose it and the Australian company who I work for has no one to replace me , so the Qatar company is keeping me hear and not letting me leave, I have done heaps to support them , recommened replacment given them two weeks notice of my departure, i personally do not have a contract with the qatar company I am an employee of the Australian company.

I have also contacted the embassy for advice Dubai nd am awaiting there reply, do you think I should get legal help???

it not illegal for the company to keep the passport? It is the property of your government not the Qatari company. What would the embassy say to such a sitution?

Do you owe anything to the company that will make them feel uncomfortable issuing an exit permit?
