can an employee terminate his contract whenever he wants?

does anyone know if an employee can terminate his contract whenever he wants, in case it is mentioned on the contract, and can we leave before the 1 month notice, in case we have a family emergency, can we give 1-2 weeks for example?

My contract says if I have to leave the company before two years i need to pay QR 18000.

My contract says if I have to leave the company before two years i need to pay QR 18000.I didnt noticed much when i join to this company, Also they promote the company as very big company. Contract is two years And I just pass one year . if i have to leave now, what could be the result?

If I have to pay him. can I use the 21 day paid leave entitlement and one year gravity.

I feel its a big trap...

Please help!

ok got it!, but when u talk about the salary, is it the basic + accomodation or just the basic?so if i have to pay the sponsor, i have to add them both?

and do u know where i can provide a copy of the labor law?

Article 49 Section 2 stipulates if the period of service is of definite period. The Qatar Labor Law is the brief representation of the policies a Firm needs to follow. Rest all fall on your Company's Policies till they dont violate the general Law.

paying the notice period means that if you want to leave with out any notice period then you have to pay the equivalent salary of the notice period. suppose ur salary is 10,000 and your service period is more than one year but less than five years and you want to leave with out notice period then you have to pay about 5000 to company in lieu of notice period.

Its all up to your employer, if you explain him your situation and if he agrees you can leave when every you want, if not you will have to stick with notice period.

If employer is terminating the contract, he may ask you to leave immedietaly or server the notice period for the reason of "Knowledge Transfer" and to avoid any legal issues related with you.

thanks for your reply, but what do u mean by if u want to leave right away, u can do it by paying your notice salary? can u clarify this matter more plz?and where u can find a copy of the qatari labor law?

Hi,

Please refer to the Part 04 Article 49 of Qatri Labour Law.

as per the law,

If the period of services is less than one year only one week notice period is requied

If the services period is more than one year but less than 5 years then 2 weeks are required.

If the period is more than 5 years then one month is required.

Moreover if someone want to go immediately without notice period he can go by paying the notice period salary.

Employee and employer has both rights to terminate the contract. If you have not completed your probationary period you can give even at least three (3) days to one week notice for your resignation but if you already completed your probationary period or you already completed a year of employment, you are obliged to give at least a month notice.

All reasons are accepted once an employee terminates the contract, for employers...it follows the company's policies before termination not unless you breached something, they can temrinate you even for a day.
