2years contract but 1yr resign
Hi everyone,
May everyone give me an advise regarding my resignation. my contract here in Qatar to my company is 2yrs and i decided to resign for one year only. i know that the air ticket go back to my home is my own expenses. i want to know is here any payment i pay to my company and they said its the hiring cost. i know that they will give it to my 21days vacation...
they computed like this;
(Basic Salary X 12mos / 365days) x 21days = 21days vacation pay
less the Hiring cost or recruitment cost...
They computed like this;
Air ticket+vise+medical test+contract/730days = rate/day
times 365 which not yet finish. is this right..
Please let me know, i don't know what is for Qatar Labour....

We have 2 years contract but our company terminated us with 5 months remaining prior to the completion of the contract. Are we entitle to receive the compensation for the remaing 5 months from our company aside from the basic compensation like gratuity and unpaid leave?thanks
I am working under 2 year contract period.My visa is renewed in previous month.Can I able to resign legally by a one month notice period under this contract period
they have included that i have to pay 18000 if i have to leave from the company before 2 years.
Can employer do that ? i feel there is some thing wrong with this. Feel that Employer trying to play here. And this is small company consist of less that 10.
I have great difficulty because employer says that he may not be able to pay the salaries because of the finacial constrains...
I really dont know why he hire like this and now because of these things I am having lot of troubles.
I can find a better job some other place (dont need to be in qatar)

As per the Qatari labor law if the employment contract is indefinite , then either party may terminate the contract. if the contract is fixed term the Employer can't terminate the contract, if he did he will liable to compensate the employee and likely the court will order him to pay the Employee the remaining period of the contact. However, the case shall be different if the Employee decide to quit the contract , it is unreasonable and not likely to happen that the court will order the Employee to compensate the Employer by paying the remaining value of the contract. Employer is such case may be paid the cost of recruitment only.
please let me know..shall i resign before completing the two years contract period. if yes..shall i get any benefit.
Now i know which trading co. you are from. Good that you resigned. Some compnies have diff face from inside which doesnt help to show dedication on work. :(
Does your attested employment contract specify 2 years or does it state "ïndefinite or unlimited" period of employment? Some employers who hire from the Philippines initially says the contract is 2 years but when you get here the employment contract is actually unlimited and they just specify in the contract that you get your ticket every 2 years. Check this out first and if your contract in unlimited/indefinite...then refer to Article 49 an 51 of the Qatar Labor Law. By the way you are entitled to your one year service gratuity if you have completed 1 year of service. Your air ticket back to your origin should be shouldered by you but I don't think they should charge you any more amount if your RP has not been renewed.
Demeter, that is only for "Open Contract". In this case it is not an open contract so OP should pay the air ticket and he will get end of service pay as said by drsam. As it is a breach of contract from the side of the Employee the Company will probably charge half of their expenses.

monthly basic/30 x 21
if yearly pay, than
yearly basic salary/365 x 21
Are you a local hire or they hire you from the Philippines? According from Qatar Law, if you'll resign and you finish 1 year in the company and you want to go back home. The company should be the one who'll provide your return ticket.

Total Cost / 730days = multiplied by remaining days... this would be the cost that i will pay less the 21 days vacation as computed like this;
Basic salary X 12/365 X 21days = 21days paid leave
is this correct???because in Saudi the computation is like these;
Vacation pay: Basic salary divided by thirty days multiply by 1.75 (21 days / 12 months = 1.75) multiply by 24 months. (SR0000/30 X 1.75 X 24 = SR 0000.00)
The resident Permit and Health card will not pay because it is only for one year.
Is this right and correct?

When you are resigning from half way of your contract it is considered as a breach of contract and they will possibly charge all their expenses on your recruitment.
