Need help about NOC

Dear Qler's

Please help to get some information. I already left Qatar on my yearly vacation in April first week this year & my company terminate me 2 weeks before due to delay of my joining back and my company also settle all my service benefit. Beside this I spoke to senior management of my Qatar employer & they asked me to send an official email requesting NOC. According to the discussion I hope I will get it. But if I get the NOC, am I eligible to come back in Qatar again anytime? Do I have to face two years ban even I have the NOC from my previous qatar employer?

Please give me some idea about it.

and it is easily traceable here because of the fingerprinting technology.  When caught, You'll end up in jail and deported and possibly banned for life!

I READ SOME FORUMS.THEY SAY IF U CAN NOT GET NOC FROM PREVIOUS COMPANY,GO TO UR COUNTRY AND CHANGE UR PASSPORT,SO WITH THAT NEW PASSPORT U CAN COME BACK EASY.IS IT REAL?OR LIKE OTHER SME SILLY INFOS WRONG? ANYONE HAVE THAT EXPERINCE?PLS ANSWER

open where you can apply even to you ex-company direct competitor or specific herein you apply first and if ever you get a letter offer, your ex-company will give you an NOC stating the company where you will transfer.  I suggest, ask for an open NOC before coming here and return here and look for a new job.  But if it is only a verbal agreement betwee you and the management, think 100 times as anything can go wrong!

Thanks for your info. Probably I don't need to fight to get it as my employer verbally agree to give me. I know some cases in Qatar who come back with new sponsor without any ban. But their new sponsor is Govt. own organisation. That's why two years ban khali balli.

Dear Himu,

I worked in HR for 5 consecutive year in Qatar. There are many people says, you have the right to demand for NOC.. The question is your courgae and patient to bring this issue to Human Rights.. Yes, you can demand based on the Qatar Law and you can fight for it... How long?... no body knows..depends on your nationality and the capability of your country embassy to back you up...

Well, the only chance you can comeback anytime to Qatar is to have NOC

As long as you have the RP, you can come back. If you get NOC, you can change sponsorship and stay. Good luck!

yes, I need visa to come back in qatar. But still my RP exist with my previous employer. I can come back to Qatar with that RP before October first week. My previous employer didn't cancel my RP yet &while discussing with them they thougt that I am going to come back with existing RP & look for new employer. may be I will come with existing RP & look for new sponsor or may be I will try to find new job there first & then come back.

it's not my employer fault, not even mine. They inform me several time. But I was not in a condition to come back in time due to my travel to other country with my Mom for her urgent treatment. There is no one in my family except me to acompany her. I am the only son to acompany her during overseas treatment. I think my employer also realize that it's not in a official way about what they did & for this they agreed to give me NOC.

Under Law No. 5 of 1981, the State, on 19 May 2004, ‎enforced Law No. (14) of 2004, otherwise known as Qatar Labor Law, where Article 43 thereof ‎impliedly amended Law No. (5) of 1981 by delegating to Employers the absolute discretion to grant ‎visa to a returning worker.Article 43 is hereby reproduced as follows:‎Any condition in a service contract shall be void when it contains an undertaking by ‎the worker to work for the rest of his life with the employer or to abstain from carrying ‎out any craft or profession which may be carried out after leaving the work even if the ‎contract is agreed before the coming into force of this law. ‎ If the nature of the work allows the worker to know the clients of the employer or the ‎secrets of the business of the establishment, the employer may stipulate that the ‎worker shall not compete with him or participate in any undertaking competing with ‎him after expiry of the contract. Such stipulation shall be valid only if it is restricted as ‎to its duration and place and to type of the work to the extent necessary for the ‎protection of the legitimate interests of the employer.The period of such undertaking ‎shall not exceed two years. ‎ ------------------- The first paragraph of Article 43 expressly prohibits employers from engaging in employment slavery, ‎and the second paragraph provides a guideline where the employer may issue NOC to the worker.Once you have the NOC, you can come in Qatar anytime!

All you need is the NoC from your previous employer, and your free to return to Qatar no sooner you have a new sponsor.

Firstly, I stand open to correction, but as far as I am aware, your company performed illegally by terminating you while you were out the country on holiday.

Secondly, if they give you an NOC to join under another sponsorship, then you can return at anytime.

All you need is love. Ooops, NOC. And then you can come back immediately! If you have a new sponsor in case your RP has expired.
