Here is a breakdown of the new labour law, beginning December 14
People in Qatar have been eagerly looking forward to changes in the labour law and the conditions of work in Qatar. In theory, the new law will make it easier for workers to leave the country and also transfer their sponsorship within Qatar.
However, there is still a lot of confusion in people’s minds regarding the new law that will come into effect starting December 14. Kochery and Partners, a legal firm based in Qatar, has come out with a detailed presentation on the reforms and changes.
Here is a drilldown of the most important parts of the new law.
Employment contract
An employment contract will regulate the relation between employer and employee.
Definite Term contracts will not exceed a period of five years. After completing five years of employment, an employee can move to another company without any NOC, provided they get approval from the Ministry of Interior (MoI) and the Ministry of Labour and Social Affairs (MOLSA).
Two year bans
At the moment, the new law does not mention anything about the prevailing two-year ban on a worker who leaves the country after resigning his job or at the end of his contract.
Dispute resolution committee
A new committee will be set up to resolve labour-related disputes. It will be responsible for settling disputes related to labour law and work contracts within a maximum timeframe of three weeks.
A judge from the Court of First Instance, chosen by the Supreme Judiciary Council, will chair the committee.
Appeals Committee
Any decision made by the dispute resolution committee can be contested at the Appeals Committee within 15 days of the original verdict. A judge from the Court of Appeal will head the appeals committee.
Exit permits
Exit permits will no longer be required for travel to outside the country. An employee will have to inform his employer three days before and and apply through Metrash 2 system.
Old wine in new bottle !
I believe the "emergency" exit cases still apply
Exit permits
Exit permits will no longer be required for travel to outside the country. An employee will have to inform his employer three days before and and apply through Metrash 2 system...................
Let's say.. someone wants to leave immediately.... to attend a funeral of a closed one.... either he/she cannot attend or.... the closed one should inform us three days before his departure from this world to another world.....
Think....
Muad is right, we need to follow the elders , even though they trust us still we need to take their permission at every step. This is good for us in the long run ...........
Same old wine in new bottle makes not difference in taste.
Read carefully the process and methods changed not the Labour Law
''....provided they get approval from the Ministry of Interior (MoI) and the Ministry of Labour and Social Affairs (MOLSA).''
hogwash !
Exit Permit.
The employer still have an upper hand its still at his discretion to let u exit or not.
Nothing has changed yet!
Hamzah: Yes It is reliable - comes from QL itself ..
Same candy with new wrapping ......
Is this information RELIABLE?
if no exit permit is required then what to apply through metrash 2?
and what if the travel is required urgently in less than 3 days?
Same thing different words, Qatar cant afford to change the laws now, especially when Word Cup project delivery is pivotal. in summary one still need a exit permit, still need NOC before 5 years.
they have introduced some restrictions for Employers but the core issues still remain in new law.
"Exit permits
Exit permits will no longer be required for travel to outside the country. An employee will have to inform his employer three days before and and apply through Metrash 2 system."
This is INCORRECT and MISLEADING.
HAHA!
where is the change? and for sure these will be effected on new contracts made onward December 14.
P.S. I wasn't waiting *eagerly* because I already knew nothing is going to change.
Unfortunately , 99% of the questions are about the two year ban..
Allahumdulliah.. but still hope for more changes
from Qatar Ministry.. 2 Years Ban remained unsolved....
This is such good news to all .. Please remember that your sponsor is like your father and wants the best for you
