PLEASE HELP

Good day!

I hope you can help us with our concerns about our rights here in the company that we're working for,

Nowadays we've been hearing rumors from our team manager that our employer is going to cancel us, me and my colleague, but never heard it from our boss. So we assume that it is true because we once had a meeting and they mentioned that they are going to cancel 10 people in our company, just in case it is true we would like to know our rights, now our question is the following:

1. Do we have the right to ask for our gratuity even we have just worked for 2 years or more than 2 years even if they will cancel us?

2. Do we have the right to ask for a Certificate of employee even if they will cancel us?

3. Are they going to provide us the ticket?

4.About the ticket they have mentioned that they're just going to give 1000QAR for it, thinking that ticket to philippines is expensive.

That's for now. I am hoping you could help us answer those questions at least we have knowledge and won't be fooled.

Anything in your contract that contradicts the Labor Law is NULL and VOID! Even if both parties have signed it. It would mean a breach of the law.

They MUST give you gratuity. It also in the Labor law. It doesn't have to be mentioned in the contract! The Labor Law is ABOVE any contract!

Sadly there are many employers / managers who still treat the workforce badly .. They should be named, shamed and prosecuted

thank you for your answers

yes it is stated in our contract that they will provide the air ticket and would cover the total cost but in reality they limited the cost until 1000 qar which is not stated in the contract.

about the gratuity, it wasn't stated on the contract, that is our most problem here. One of my colleague almost didn't get anything from her 3 years of service, but she fought and reached out to the labor, and when the labor called our employer, he was very furious and treated my colleague like a criminal and sent her out of the company right away without any formality, and spread bad rumors about her. -_-

I just wish all employers aren't like this.

As for the certificate, we will fight for it cause it is the only document that we can carry out after leaving the company.

The return flight doesn't have to be in the contract because it is in the Labor Law!

Article 57 Upon termination of the service of the worker the employer shall at HIS cost return him to the place from where he has recruited him at the commencement of the engagement or to any place agreed upon between the parties.

1. Most Definitely and it is part of every work contract in Qatar. You can claim your gratuity for 2 years as it is calculated on yearly basis.

2. Certificate of Employee can be issued any time by the management upon request. As it does not cost them any penny. :)

3. Refer to your contract document. Normally in Qatar, standard work contracts includes the clause of paying air tickets to the employee to return to their country after termination.

Hope this helps.

They must pay you the gratuity as long as you have worked more than a year.

You should request a certificate of employment and they would likely provide it

If they terminate you, then they have to pay your air fare.. You don't have to contribute

1)Gratuity is calculated on yearly bases so you will get it for two years it should be written in your contract..

2)Yes you can ask for the certificate its not a big deal for them.

3)not sure about that question again it will be in your contract that they are going to give you the ticket or not..
