Complaint with Labour Department
Got the chance to help one of fellow kababayans here in Doha. He was a waiter before in one of the restaurants in City Center. He was verbally dismissed by his supervisor who happened to be fellow kababayan din naman. The reason for his suspension - having an affair with her co worker.
Since he asked for assistance, I helped him all the way to the extent that I even made advances (money) for his expenses. But in the end he entered settlement amicably without my knowledge. He is now in the Philippines and jobless!
I just want to share the experience, the process and information I gained from this event:
Human Rights Commission advice on the following issues:
1.) SPONSORSHIP: An Employee may ask his New Manager to talk to his previous Manager regarding the Sponsorship transfer. His previous (OLD) Manager will inform and seek approval from the OLD sponsor.
or:
An Employee may go directly and request from his NEW Sponsor to talk to his PREVIOUS (OLD) Sponsor regarding TRANSFER.
SPONSORSHIP TRANSFER depends on your previous SPONSOR, lucky you if you get an INFLUENTIAL NEW SPONSOR so that transfer would not cause you much trouble.
2.) SUSPENSION, DISMISSAL OR TERMINATION: An employer may terminate an employee with cause. Suspension should not be exceeding 5days. For more details see Article 59-62 of Labour Code. Mere accussation must be proven in the court, otherwise, cannot be used as ground of your termination.
LABOUR DEPARTMENT COMPLAINT
1.) Get a Complaint Form at the Labour Department
2.) Complaint Form/Letter must be filled up in Arabic
3.) If you have letter-complaint, it must be translated in Arabic before the Labour accept the formal complaint.
Once the complaint form/letter is being filed, they (Labor Arbiter) will ask you to handed down the letter notice of hearing to your employer personally.
NOTE:
The NHRC advised us to avoid certain person in the name of Mr. Favor-to-Employer (PM me if you want to know the name). Your complaint might not push thru against the employer or your case will be one of the "JUNK Cases"
