What should i do?
I am working here in qatar for more than 3 years. Unfortunately, I have to go back home to my country due to my illness. My employer don’t want me to resign he said if im ok then I can come back. Two months later, I recover from my illness, but that time my working visa was already expired. Therefore, I wrote him a letter to resign from the company and request for NOC. When I am already six months, I ask my husband here that I want to come back so he talk to my previous employer and we got new visa, unfortunately my employer decreased my salary that I previously get from company.
I don’t have any choice so I accept it but I paid my own ticket to come back. My question is if I find another company did my employer have the right to cancel me and bring me back to my country? Or Ican I transfer to other company, I have my NOC with me. But this is written in Arabic so I don’t understand if it’s still valid or not. What action should I do? Please, I need your advice.
Please remember that you resigned and therefore company has to replace you. When you came back and accepted the offer you are treated as a new employee. Of course you have all the right to ask, but dont forget they also have the right to refuse.
Yes, it's true I accept my salary even my employer degraded my salary and position. I even explain the reason why I resign is because I am sick that time. But you know what my employer place me again in the same position as a temporary replacement since they hired a new one when i am resigned from the company. Do i have then, the right to discuss with him to bring back my previous salary?
1. If you are on the company's visa, sure they have the right to cancel your visa and put 2 years ban.
2. Your previous NOC has no value, as you already came back and have now new visa stamped.
3. You cannot take any legal case as you are the one who accepted the agreement and your company is not violating the agreement terms and conditions.
4. But still you have one option. If your husband is in the position to sponsor you, mean he has salary package above 7500/-, then you can resign in the polite way and go back to your country, so your husband can get a family visa and you can come back. But still if you will insist for transfer to husband visa, they can refuse and you dont have the right to ask for NOC, which is also required for the husband visa in case of transfer here in Qatar.
