On behalf of my brother I would like to ask you few advises.
He joined here in a small private company as Engineer on mid of January 2011.
At the time of interview he had two back papers and we informed the same also.
As he had back papers they offered him only QR 2000/- as salary and asked him to do all the jobs irrespective of his qualification.
With consideration to live with other family members, he also agreed the same.
Now as his exams are coming he wants to go back. But the company is telling that if it is so we have to give them QR 10000/- for the expenses met for him (Like visa and Driving License) and they will make cancellation with out NOC.
I know it is not genuine but as the time span is very low, I am totally confused.
If you have any advises to overcome the situation trouble free please let us know.

Dear, you did not specify weather his contract is limited (one/two) years contract or unlimited, because each of these has defferent conditions and terms. anyhow, and under any circumstances and per the qatari labour law "the company is responsible for all expences concerning visa or residance permit and license fees without any deductions from employee no matter what. there is something call emergency leave, casual leave, unpaid leave and midterm leave in addition to the anual leave. in your case, an employee can obtain unpaid leave without ticket (Per the Qatari labour law ticket can be obtained after completion of 365 working days along with his anual leave.the Qatari law didnot include any conditions for releasing an employee. it is up to the employer to release or cancel the residance permit of an employee.the salary that is mentioned in a contract signed by both parties will be executed.

He is not resigning. Company is terminating him due to week performance. and hopefully they will advertise the same in news paper.

I could say the the company has no right to deduct the QR 10,000 as expenses incurred for his visa processing & driving license as he already finished his probationary period. But they can charge the expenses spent for the driving license if he has a written agreement with them to take the whole amount once he terminate his employment from the company.
I am not an expert but I can give you an answer to your query. However, you didn't mention it clearly if your brother is resigning from his job. Please clarify if he will just go back to your country to take the exams or he will also resign?
If he is resigning as well, the company has the right to take some monies to your brother as penalty for breaching his contract. The computation will be based on the remaining duration of his contract but it should not be more than the equivalent of his 6 months salary.
I could say that the company doesn't have the right to take the QR 10,000 for the expenses incurred for his visa processing and driving license as he already finished his probationary period. However, they can charge the driving license expenses if they have a written agreement with your brother to take the amount spent from him once he terminated his employment.
