Need ur expert opinion re my wife's NOC

My wife is working as a saleslady in a mall for small company run by lebanese couple. They gave my wife 3 months temporary working visa as a probationary period. Fingerprinting is not yet done. If my wife resigns before 3 mos is expired can she get NOC? I know it is up to employer but somebody told me that it is a mandatory for the employer to issue NOC if u got separated from the company within 3 mos probationary period. Pls need ur expert opinion in this something that is technical-based or per qatar law. Thnx
Flor..she has tourist visa b4. It was changed by her employer to 3 mos. "work visit visa" (that is what is stated in the MOI printed paper). I think this is the one issued by employer to give time in the processing of our PATAKA.
what kind of visa does your wife has BEFORE this Lebanese company took her. You told us that she was locally hired, so what kind of visa does she hold, visit, business, residence? What?
If she has not fingerprinted then there is no work visa. During probationary period either side can decide not to continue with the contract. She will need no NOC.
To transfer from doha before fingerpriint you have 2 options and either way you need a new approval from the labor department.First get Noc from current sponsor and have valid new approval for the visa from any company willing to hire your wife and change directly over here ORExit and return back with new visa NO NOC is required for this coz her RP is not yet stamped on her passport
Ana...I hope ur last statement is correct..inshalla...bcoz it seems these lebanese employers will make it hard for us to get NOC...How & where can i check if no NOC is needed in ur next job if u have not fingerprinted yet?
Flor...my wife is under 3 mos. working visa given by her employer but according to them (employer) they (employees) won't have fingerprinting until 3 mos. visa is finished bcoz they are still under probationary period. B4 the end of 3 mos. and employers like their performance that is the time they will have fingerprinting and be a regular employee. If not, they will be released. Now, im confused bcoz its obvious that they dont like my wife. I feel that any time she will be terminated that is why i want her to resign. The question are... can we get NOC from them? or it is not anymore needed in her next job bcoz she was not fingerprinted?
was your wife under your sponsorship? Or she is under the six-month visit visa and trying to find a permanent sponsor?And aspr your query, it is not mandatory to issue an NOC if locally hire but it istill depends on what kind of visa your wife has for now!
my answer was based on my situation too. i was also local hire but my sponsor doesn't want to give me release to transfer so they gave me 2options: either to spend a year with them or exit the country and they will give me NOC!in my case i had my fingerprinting already. i believe if u haven't completed it yet, u can change the company even without NOC.
@anaana Hmmm... my wife is a local hire.. company did not spent a cent to her coming in doha why does she have to exit...and she has no fingerprinting yet. Anyway.. thanx al lot for all ur reply...God bless. I hope somebody with good knowledge in this share some thoughts.
neither i. haven't heard "temporary working visa" but if cherukkan is right, you have to work under ur sponsor for at least a year.However, my sponsor told me that if your current employee doesn't give u release to transfer to another company, you can ask for the visa of ur wife to get cancelled and ask for NOC. In that case, she'll have to exit the country but she can come back within the day provided that she has NOC. That scenario is I guess much better than waiting for a year (in case her sponsor doesnt want to give her NOC to transfer).that's what i know. just verify it to others.goodluck:)
I think she might be on three months buisiness visa,if this is the case then she can resign and can go for another job,and no need of NOC from the present employer.But she has to exit Qatar and can come back on new visit or employment visa.
noms, that is the work visa. Expatriates will normally enter on a single entry visa (employment visa) valid for one to three months and in this case they did not process the RP which will extend the validity of the visa for an year or two. If she is resigning from this probationary job she should get another work visa to work. Sponorship can only be tranferred after an employee has worked for their original sponsor for a minimum two years
I never heard of 'Temporary Working Visa' .. is that a Business Visa ?!
