Dear All, ur immediate help is highly appreciated.
I have completed 1 year and 1 month in my current company. Now i am trying for a change to another Co. and my work visa is valid. But some says, any company can't give transfer/NOC until and unless u complete 2 years. Is it True? pls, help me at the earliest.
Angelo, it has nothing to do with duration of the contract. Moreover, the issue is not with the Company giving a NOC or not. Some companies are willing to give a NOC any time. But.. Based on the existing rules, the application for transfer of sponsorship won't be approved by the relevant office unless the employee worked with the same company 2 year. Some exceptions are allowed though.. but you never know..
It depends, if your contract is for one, two or three years. If it is for one year, you can request an NOC from the HR. If your contract is for 3 then you need to wait for 3 years before you can ask for an NOC
It also depends on what is mentioned in your employment contract about the transfer or NOC
Officially the rule is 2 years with one employer before you can change your sponsorship to another company.
If however you're "western expatriate" - the change of sponsorship may be approved after one year (note: MAY be --- it is not guaranteed). If you are Asian - two years definitely stands.
