landlord problem

Hi Guys!

I am facing this strange problem. I would be happy to hear any good suggestion in this regard.

I took a pent house in villa for rent in nov 2009. While making a contract I had asked to mention the termination clause in the agreement and the agent did it but it is written with pen like the below:

Termination clause: if the second party wish to evacuate the property then the second part has to give three full months notice in writing.

The contract is for 1 year. I have issued pre paid check till june 2010. I have given one month rent as advance. Now the problem is I want to leave the house due to some personal problems in march and I called up that the agent and informed him but he is speaking with rude manner and says that only after june check is clear I can leave and I had to honour the 1 year agreement and he will not agree before june.

He is so rude says do what ever you go to police, etc.

Can anybody suggest what will be good way to opt at this junture?

Same problem happened with my friends and he paid all rent upto last cheque.

1. Don't fight with him, deal with him in a nice way and explain the situation and try to pay one month rent extra and get the cheque back if your can.

2. He is landlord so he might face many times same kind of problem so he know how to deal, that's why he is saying go to police or etc coz he knows that you are weak in case.

3. If the contract says that either party can terminate the contract then you can reach to the court but before that seek guidance from some good lawyer.

4. Don't keep the keys with you if you file the case otherwise you will loose.

My fried did same mistake and on this point only he lost the case and court will not stop the cheque though if you win the case then he will have to repay you.

You have to seek a legal advise if the termination clause written in pen in the contract is binding and signed by the landlord. If it is legal, then follow what is required for the termination.

Else, I agreed with others that you need to find a replacement.

I think the best is to seek legal advise. Initial it would not cost a lot and might be even free advise. They would be the best to assist and advise you.

bROTHER, WHEN YOU ISSUED CHEQUES TILL JUNE THEN ITS AUTOMATICALLY SAID THAT U HAVE TO FINISH UNTILL JUNE THEN HOW YOU CAN LEAVE THE HOUSE IN MARCH, UPON ISSUING CHEQUES YOU SHOULD HAVE ISSUED 2 OR 3 CHEQUES TO AGENT NOW EVEN IF U TAKE LEGALE ACTION ON AGENT IT WANT WORK SO BETTER TALK NICELY TO LANDLORD AND EXPLAIN HIM UR SITUATION OR YOU CAN FIND SOME OTHER PERSON TO STAY IN HOUSE AND U CAN MAKE UNDERSTANDING WITH THE SAME PERSON TO DEPOSIT HIS CHEQUE AND TAKE YOUR CHEQUES BACK.

to avoid confrontation, get someone who will take over the place you're living in. Otherwise the agent will not give you your cheques back. Involving police can be pissing off if you don't speak arabic. GOOD LUCK!
