Confusing NOC situation.

Hello all, and yes i know this is another NOC question but i keep getting conflicting responses from people i talk to.

The situation:

- Have been working for a company for three years here in Qatar.
- Was initially hired locally (not from overseas)
- Have never received a letter or email of bad performance or warning.
- I have received successive increments & promotions to the point where I have more than doubled my original hired salary.
- new management came in in December and now I hate my job.
- I have found another job in Qatar (received job offer)

Question:
Can I resign and expect to receive an NOC?

(part of the new bad management is they have been denying NOC's to terminated and even demobilised long term staff)

I have been told by some that because i am local hire and i have been here for more than two years i am ENTITLED to an NOC... is this true? and if so, how do I enforce that entitlement?

Is there any legal contacts that anyone can offer? lawyers?

PLEASE your help is appreciated... This used to be such a nice company to work for...not anymore...

Koala, there is a written law on NOCs. It says that they are at the discretion of the employer. There are no legal circumstances that mitigate an employer's decision or entitles the employee to an NOC. The employer MAY give an NOC or send the employee home for two years.

There is no law can help you with this.

If your company refuse to give the NOC that mean you dont have any choice my friend.

Like our Friend Armagedon says your only choice is to ask from your new company a business Visa but you must get out from the country to renew it.

So there must be a written law on NOC's then, since they form the backbone of labour in this country...

There must be clear outlining definitions on all the requirements for an NOC, and surely not just "company discretion"...

Is there no time barring at all for requirement of an NOC?

NOC can be accorded to you depending on the mood of your bosses. It entirely depends on your bosses. If you are in good terms with your bosses, they can all bond together and say YES! Give him NOC!

Some companies have rules and procedures regarding NOC which some bosses adhere into it religiously where of course, they may religiously not adhere too.

Best thing is to stay calm and nice to the new bosses and seek their consideration to grant you NOC.

I don't know why you would be getting confusing answers, sorry. NOCs are not automatic under any specific circumstances. You may ask, it may not be granted. Legally, it is solely the prerogative of your employer.

NOC depends on all company whether you are locally hired or not. The best thing to do is to ask a letter offer from new company and present it to your present company now and wait for their reply if they can match the offer or not, if not, thats the time to ask for you to ask an NOC and then crossed your finger.

The ONLY solution for you is to convince your new company to give you a business-visa. Meaning you would need to fly out/in every two months.

There are as far as I know NO laws with regards to NOC's, you are in the same boat as me my friend. My boat already sank....

In Qatar, entitlement to some things does not really mean that you are entitled to it. it would be similar to the carrot that is tied on a stick and kept in front of the donkey to keep it sloggin..

keep in mind that you are working in Qatar and the employment contract that you sign is not always worth its value on paper..

so, my suggestion is to negotiate with them and reach an agreement. else my dear koala, i see only one way out for u and that is on the next flight back home..

Answer:

Not really, u could receive a flight ticket back home and not be able to come back for 2 years.. harsh reality but a probability.

Request from your management for an NOC with your new job offer and contract. They might consider giving you NOC. but to clear things up with you, even if you were hired locally or overseas, it's not automatic that they will give you NOC. Even in my company and even the Senior Management couldn't ask for NOC from the GM/President/CEO even if they are both the same nationality.

But if youre current company is closing down, they would probably give NOC to you.
