Paid annual leave considered as on duty or off duty?

Can anyone advise please.
As per qatar labour law if employee moves on annual vacation it is considered off duty or on duty.

Please advise if the following is correct.

Mr Daniel Joins the organisation on 1st Jan 2007 ,He moves for 30 days annual leave w.e.f 1st Jan 2008 after completing one yaer. He resumes duty on 31Jan 2008. When he applies for annual leave again on 1st Jan 2009 he was told that his annual leave is due on 31st Jan 2009 (365 days after he resumes duty from his last annual leave.

What does Qatar labour law says.

An employee should complete the whole year first before taking the first annual leave then the succeeding year of his leave will be after the completion of 11 months. So he can take his 2nd annual vacation a month before his joining date.

He is entitled for annual leave after completion of one year ( as per the contract) notwithstanding in which month he took his annual leave. This will not affect his annual levaes entitlement. The actual period is to be calculated from the date of his first joining.

For instance

If I joined office on Jan 1, 2009 and I am entitled for 1 month annual leave, I took my leave in March 2009. This will not affect the entitlement of my second annual leave i.e. my second annual leave would be due in Jan 2010 as per the original cycle.

I am not sure it is correct actually. Although i can’t find the clause in the Labour law which defines this. But in my experience this is my judgement:

1st Jan 07 he commences work, 1st Jan 08 he completes one year, and as such is entitled to 4 weeks paid leave. (or whatever his contract says) The 4 weeks are obviously taken in 2008. As far as contract law is concerned there is no distinction made between time spent in the office and time spent on paid leave, therefore his 2008 leave is based upon 1st Jan 08 – 1st Jan 09.

His end of service benefits are also calculated on this basis.

Looks correct...!! These are also specified in the company policy, where it states how many leaves are allowed to a person. Check out the contract that you have with the company....

Yes! this look correct, an employee is usually entitled to paid annual leave 1 year after a new contract begins
