HI FRIENDS

I JUST WANT TO KNOW THAT WHAT SHOULD I DO IF MY RESIGNATION IS NOT ACCEPTED? I HAVE ALREADY RESIGNED AND GIVEN 2MONTH NOTICE PERIOD WHICH WILL END ON 7/05/09.

IF THE COMPANY DOES NOT RESPOND ME OR SETTLE MY GRATUITY WHAT SHOULD I DO.

AND I ALSO REQUESTED FOR THE RELEASE AS I WAS RECRUITED LOCALLY

AWAITING YOUR VALUABLE REPLIES.

There is a very clear clause in the Qatari Law that provides for either of the parties - Employer or Employee to have the right to relieve themselves from a contract subject to giving a NOTICE of a certain period. Generally this period is one month, but in cases where the employee has been with the employer for a long period (don't remember specifically the period, I think it may be 10 years and more), the notice period is 2 months. Therefore irrespective of whether the Resignation is accepted or not, upon lapse of the minimum NOTICE period, you are eligible for relieving yourself from the contract, of course provided there are no legal claims and objections against you during this period, which could impact the whole dynamics of the situation. If the Employer plays hanky panky with you, you could approach the law immediately with the necessary documents of proof to support your stand.

As for the Release / No Objection for Transfer of Sponsorship, please note that this is purely up to the current sponsor's wishes and policies. It does not matter whether you are a local recruit or international, the decision is 100% current sponsor's. There is no law that mentions that one should be given a release if they are recruited locally. Hard luck on this latter part!
