Gratuity...

I was employed for one (1) year and two (2) months, and recently, the company terminated me (april 12) verbally. Now my question is: Is there any gratuity or benefits i could get from the company? and how could i make an action if ever the company didn't give any benefits?

If anyone out there knows about this matter, please respond ASAP.

If i am not mistaken, here in our company, as per Qatar Labor Law (they say), if you will go for vacation, you are entitled for the yearly leave pay. If you resign from work, your gratuity will be calculated as 21 days x years of service. However, if the employer terminates you, the calculation will be 21 days x years of service + 1 year leave pay. This is the system we are following.

Dear Friend,

You are entitled for 21days from your basic salary,

Apart from that company cannot terminate you by just verbaly, they should issue you a termination letter.

suppose if your company refused to give you the gratuity, you don't have any prove to say to the court that you have been terminated. and you cannot make any actions against them.

Basically a company can refuse to give you the gratuity if you have caused anything against the company policy which will be a lost for the company.

Anyhow fight for your right mate!!!

You have the right to claim your gratuity according to Qatar Labour law. If they just terminated your contract verbally and they ddidnt gave you notice thats another case. You can go to the labour law in C-ring road and ask for advice and if you want to complain you will go to Labour Dept at Industrial area. St. No. 13. They will help you there. But as far as the same situation with you, you have the right to be compensated as per your contract. Hope things will be fine for you too.

I agree with Withnail that even if in ur work contract there is no clause mentioning the gratiuty, the company should pay u according to Qatari Labor Law 3 or 4 weeks salary (as mentioned in the contract or the ammount of money they transfer to ur banl account)per 1 year of service. is they dont pay, u can go to the labor law

also, end of service is part of the labour law - it does not matter what your contract says.

you should check the labour law, but the end of service (if i am not mistaken) applies to anyone who has worked over a year, and it is 3 weeks wages for each year you have worked - prorated for any partial years.

hi friend

you are entitled for 21days gratuity as per your basic salary.

this is your right and you should get it if company is not willing to pay you this amount you should go to labor court and i am more than 100% sure you will get this amount.

and also the company should pay you the returned ticket and they should give you a period so that you can close all your bank acount. qtel connection and if you are having your own car to sell it out.

OK first of all: is there a signed contract to check any gratuity clause due to End of Service (EOS)?

If it is in your contract then yes you con fight for that....if there is no such clause then thats it.

On the other hand I do not know the Law in Qatar, but maybe doing asearch in QL can provide you with a lil more detail.

Also there have been several posts on this topic...my suggestion is to do a search by the word "gratuity" and you will find lots of reading.

Or google for Qatar labor (labour) law. Obtain the exact up to date data on gratuity and print it out in case you need to present it to your employer to obtain your rights.
