IF THE COURT SAY VACATE THE HOUSE
Dear sir/madam,
If the decision of court say " vacate the house"
My question is HOW MANY DAYS OR MONTH to compy with...
base on the existing Laws... any certain period ?.. lets say within 1 month or 2 month or etc.... so we can find suitable place during that period... Shall I pay my rent also during that period.. Please Answer as i need to plan accordingly..
thanks for your assistance and legal opinion.
it should be not less than 2 months notice period.
okey i will keep it noted mr hashim..
Question again ... just in case you need to appeal to the court how many days period to appeal, certainly there is lapsation period of appeal , right?.
Piloy, the procedure from the court is a first notice (without any date), second notice (same) and then a court ORDER with a specified date which you can still appeal against for reasons like you can't find accomodation etc. But in case the landlord has applied to the court on the grounds of demolition, then HE HAS TO provide you an offer of a similar accomodation for the same price before being able to vacate the property.
thank you mr allen, hashim, mr fubar and other Qler's... to all reply and opinion and comments...
I am very much appreciate also who initiate this site ( qatarliving.). this will help us lot to get some good informations we need to know..... Once again thank you
There was an article in the paper this week about tenants being evicted from their accomodation in Mushreib because the building is to be demolished and the site redeveloped by Qatar Foundation (QF in my opinion is acting more dishonourably and dispicably than even the lousiest of landlords). The eviction notice I think gave them just 2 months to leave, and this was upheld by the court.
You seem to be saying that you expect the court to say that you have 1 week to move out, and you want to appeal?
pilyo, that is the reason why I ask you to get a copy of the court order because definitely if it is coming from the court surely there will be a specified period. THat is why I mentioned about court order so we can be sure that the notice is really from the court and not just from your landlord. Otherwise, if it is from your landlord alone he cannot just evict you without proper notice and time. More so if you have a signed contract. Unless you have violated any of the terms of your contract with the ladlord he cannot just evict you. In such case you have the right to also complain to the police if you will not be given ample time to vacate and specially if you have paid for this month.
yes you are correct mr fubar..... i am expecting similar situation ...that is the answer i need to know....thank you ....from Qlers legal expert or lawyer in here ? any reply aside from mr fubar
thank you mr hashimozotamo.... as soon as there is decision i will PM/tell you...... because i am planning to go court. to fight for same right .... because somebody said..... if decesion made by the court is to vacate the house ... you have only 1 week time frame to find accomodation or else police will come and force/evict you to vacate the area ....... what is the use to go to court if only 1 week is the time frame period to find new accomodation.?
Piloy, if you don't know what the document exactly says because it is in arabic or sthg, pm me a scan and I'll tell you what you want to know. Be glad to help you out because I am also facing the same problem.
fubar, thanks for reply.... when If the kind and good person what they want only is they want you to acate the area and landlord follows the order of the court... generally speaking or similar situation.. WHAT EXACTLY THE TIME FRAME OR PERIOD THAT THE COURT ALLOWED YOU TO STAY TO FIND NEW ACCOMODATION....

If it's from the land lord, then hashim is mostly, right. Although there are more and more stories coming out of land lords switching off the electricity, water, and elevators to force the tenants out, even if it is against the law.
thank you hashimmozotoyama for comments......any comments from legal expert/ solicitors Qler in here....
Is it a court order to vacate , or the landlord's notice stamped by the court to vacate? Cause if it is the latter then you don't have to worry for now. As far as I know there is a Decree by the Government putting a hold on all rental contracts due to the accomodation crisis. Meaning that your landlord does not have the right to vacate the house except if he can prove that he or one of his children wants to move in (which is rarely the case) or that it is scheduled to be demolished. So make sure what the document exactly states.

Thank you for your reply..i collate all the ideas, any other Qler in here, that they know similar situation or actually happen to one of your friends....
ask for a copy of the court order, usually court will specify the time within which you are to vacate the premises. then you have to follow the stipulated time.
