tenants problem.need ur help pls.....
We just transferred to a new house 2months ago under a real Estate.2 weeks after problem started when the second floor was already occupied water is draining continuously from ceiling and on the wall inside our room.We complained it to the management for almost everyday and they just sent somebody just to check (Engr.)and no action taken from the management and i was surprised when I talk to their boss and telling me that its not their responsibility to fix the ceiling and it is ours .for more than 2 weeks were suffering like we have falls inside our room and xmas had passed still they're not doing something.27th of Dec. they fixed it for more than a week.....after 4 days again the same problem occurred and it become more worst than before coz its already in the electric wiring's spreading.The same thing we did we informed them almost everyday as what they did before they just sent again their Eng'r.and one of their staff checking and promised to us that they will bring their Boss to show to him but unfortunately none of their boss gave time to our problem.For more than 2weeks they did nothing i felt so bad and upset coz theyre not taking care of us tenants..My husband and i decided to vacate the place this end of the month and we gave letter to them but theyre not allowing us instead they promised to repair on saturday as what the police told us but we are already decided to vacate the place...
Please give us some advise on what to do coz we have exsting contract for 1 year,we issued post dated check and 1 month deposit.Do we have the right to file a case to the real Estate?........

We gave them enough time to fix for the second time for more than 2 weeks when problem re occurs but they did nothing .Now that we are finally decided to vacate this end of the month and file complains for us to release they told us that they will fix and promised it today...THis real estate from the start we transferred we encountered a lot of problems from the drainage but heyre not minding....we are already feed up and we are not happy coz theyre not taking care of the welfare of their tenant....anyway thnx a lot to your advise.
Mandi is right, give all the chances and if not fix right, then you do the next step..

If your landlord has promised to fix the problem then you must give him the opportunity to do so. Otherwise you won't be able to unilaterally break your lease. The amount of time considered reasonable will be subjective. Make sure you give him all chances to make this right before you break the lease, otherwise you could be left holding the bag.
