Wouldn't the third party insurer of the car which made the mistake, pay for the damages of both cars?
This was the case in UAE. I want to know, how is it here.

marycatherine is right. I think anywhere in the world 3rd party insurance will only cover the other party's vehicle or property, not your own.
If you have third party insurance on your own car and YOU cause an accident - it pays for repairs only to the other car, not yours.
Comprehensive insurance (or full cover) would pay for repairs to both cars
This is true in the UAE as well. Third party protects others not ourselves if we cause the accident.
