Can i take legal action against d bank?

Can anyone tell me if I can take legal action against d bank for passing a cheque dated for 2009? I have still not got d amount back that’s been cleared wrongly. What do I do? This action of amount clearance had been made from the account two months ago. It was only let known to us when we had investigated for funds not tallying in our account. Is there a Lawyer who could help us out?
