Once again a Child Suffers - Stupid Adults

A 13-day old baby girl lying abandoned in hospital may become India's first surrogacy orphan after her parents divorced weeks before she was born and her mother refused to take her.

The custody of the child, named in reports as Manji, born to an Indian surrogate mother and intended for a Japanese couple, hangs in limbo after the pair divorced.

Ikufumi Yamada, 45, and his then-wife Yuki Yamada, 41, had signed a surrogacy agreement with Priti Patel in November.

Commercial surrogacy has been legal in India since 2002 and the child born of such an agreement is then legally adopted by its biological parents.

But Indian law does not allow single men to adopt.

As he divorced shortly before the baby was born, that means Ikufumi Yamada may not be able to adopt Manji.

In a cruel twist, mother Yuki Yamada has decided she no longer wants the child. The surrogate mother Priti Patel has also left the child.

Manji is currently in a hospital recovering from an illness in Jaipur city in western Rajasthan state, said Dr Sanjay Arya.

She is now being looked after by Ikufumi Yamada's mother.

Dr Arya said: "The grandmother becomes very emotional when she is told that the child cannot be taken out of India. The lawmakers will have to find some solution for this."

Without adoption papers the baby girl cannot be issued a passport or leave the country, Arya said.

Experts say commercial surrogacy - or what has been called "wombs for rent" - is growing in India.

While no reliable numbers track such pregnancies nationwide, doctors work with surrogates in virtually every major city. The women are impregnated in-vitro with the egg and sperm of couples from all over the world who are unable to conceive on their own.

Surrogate mothers, often poor women with little education, earn between £2,250 and £2,500000, plus all medical costs, for the service.

Most couples end up paying the surrogacy clinic about £5,000 for the entire procedure, including fertilization, the fee to the mother and medical expenses.

actually according to the indian law, if a single parent wants to adopt he/she has to adopt a child of the same sex as the parent. if the mother of this baby were willing to adopt , there wouldnt have been a problem .but sadly the child pays for the adults mistake!!

it was mentioned in the thread. Since the couple divorced, the father is considered "single" so he can not get his biological child.

That's why I said, it is a good topic for debates in the court because it is now a question of interpretation of the law. It is either retroactive or concurrent but for me, whichever is beneficial as in this case, it is the life of the child at stake.

If they decided in favor of concurrent stage (meaning after the divorce), then Brit is right, another child suffers from the stupidy of adults, but if they decided as in retroactive (meaning at the time the surrogacy agreement was signed by all parties), then everything will end well.

Another twist is that Yuki Yamada is not the biological mother. They got the egg from another donor.

Its unfair to expect the people who worded the law regarding the adoption of a surrogate child could have anticipated a situation where the surrogate parents would be separated when the child is born...

Besides... its unfair to say like mighty solomon did in his comment that 'Indian authority prohibits it'...

The article says... "As he divorced shortly before the baby was born, that means Ikufumi Yamada MAY NOT BE ABLE TO adopt Manji."

So all this could prove to be storm in a tea-cup, just a matter of a few phone calls to sort out the issue... bit of sensational journalism if you ask me...

the biological father is all-too-willing to get the child, it is the Indian authority based on their law that prohibit it. The law should protect the child, actually, the authorities here misunderstood the law. When it is true that single person (biological or not) can not adopt a child, the surrogacy agreement was signed when they were still together, so the divorced that happened should not stopped the father the right to get his child.

Well, of course it will be a highlights of debates in the courts how to interpret the law but for me, it should be interpreted in such a way for the betterment of the situation and not to worsening a situation.

Maybe, another good twist will be, the reason for the divorce was the child itself???????????

keep the child.. Let's hope it works out for the best..

Perhaps in future, the prospective parents should be made to deposit a bond with the government, which would cater for the upbringing of the child if things go wrong..

realsome even if the kid was a boy the mom who gave birth wud've abandoned it coz techincally its not her child. And I'm sure she became a surrogate mother for some money or something. If she had to do that for money how will she be able to take care of a child. You're so twisted. Why do u have to find a twisted angle in every single thread?

that when someone wants to adopt a child there are all kinds of rules and laws but any teenage girl can get knocked up and end up as an unwilling parent and no rule or law intervenes...

She obviously doesn't want to be landed with a child which is not her own..

probably why the women abandoned the girl is because this traditional thing in india that leads the girl;s family to pay so much money for her marriage.

they really need to abandon this practice.

I hope they could do a proxy marriage quickly... so that the child can be taken home with the father without too much fuss, legal paper work and other delays...

but this is a real scary scenario... couple deciding to have a surrogate child and then both not being able to adopt the child...

Legally, I am confused as well... why do the biological parents have to 'adopt' the child...

This guy is the biological father of the child!!

I worked for an orphanage and an adoption agency for bi-racial children in Korea, and it was a similar situation. Korean tradition is pretty against adoption anyway and to adopt a bi-racial child is COMPLETELY out of the question. Also a child can't be adopted without the premission of the father, since most of the mothers are either prostitutes or girls who got knocked up by their GI/English Teacher boyfriends who've left the country, they don't even know who the fathers are much less where they are and how to contact them, so these kids just languish in orphanages.
